eCoolroom Pty Ltd ABN 25 676 146 606 (eCoolroom, we, us or our) is committed to acting in accordance with the Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth) (Privacy Act).

This Privacy Policy describes eCoolroom's privacy practices in respect of information collected through our website ebutcher.com.au and its subdomains (Website) as well as through the food and drink product and meal ordering platform made available through the Website and the eCoolroom mobile application and associated services (Platform).

eCoolroom operates for users aged 16 years and over.  The Platform allows customers (Users) to find and order food and drink products and meals for delivery from food and drink vendors and restaurants (Vendors).

Our Privacy Policy applies to individuals who are, or who represent, Vendors and Users as well as any visitor to our Website, our contractors or service providers and any potential employees of eCoolroom (you, your).

We understand the importance of, and are committed to, protecting your personal information.  This Privacy Policy explains how we manage your personal information (that is, information or an opinion about you, whether true or not, which identifies you or from which your identity is reasonably identifiable), including our obligations and your rights in respect of our dealings with your personal information.  By using the Platform, you are giving your consent to us handling your personal information in accordance with this Privacy Policy.

We may revise this Privacy Policy from time to time by updating this page. The revised Privacy Policy will take effect when it is posted on the Website.

  1. How we collect your personal information

    Where it is reasonably practical to do so, we will collect your personal information directly from you. We will collect and hold your personal information in a fair and lawful manner, and not in an intrusive way.
    We may collect the personal information in any of the following ways:
    1. when you make an inquiry through the Website;
    2. when you register an account on the Platform;
    3. in administering and performing any contracts with service providers;
    4. when you contact us by telephone;
    5. from correspondence (whether in writing or electronically);
    6. when you interact with our social media accounts;
    7. when you use the eCoolroom mobile application;
    8. while conducting customer satisfaction and market research surveys;
    9. when you subscribe to receive eCoolroom's marketing materials; and
    10. otherwise in managing or administering the Platform or our business.
  2. Third party collection

    To facilitate the functionality of the Platform and our business and marketing activities, eCoolroom may combine the personal information you provide with information that is not collected directly from you where it is unreasonable or impracticable for us to collect that information directly. Personal information not provided directly by you may be supplied by Vendors, publicly available sources and third parties, such as suppliers, recruitment agencies, contractors, our clients and business partners that support eCoolroom's business and marketing activities.

    If we collect personal information about you from a third party we will take reasonable steps to ensure that the third party informs you that we have collected and are holding such information, how we will use and disclose it, and that you may contact us to gain access to and correct and update the information.
  3. Types of personal information we collect

    The types of personal information we may collect may include (but are not limited to), your full name, date of birth, postal and/or delivery address, email address, phone numbers and billing information. We may also require photo identification.

    If you are a sole trader, we will also require business details about you including your trading name, a valid ABN and business location.

    We may also receive location data from your devices and networks to provide the functionality of the Platform.

    We may request you to opt in to allow us to use your precise location for certain tasks, including for example so that the Platform can suggest the Vendors in your area.

    We may also collect and hold sensitive information about you, including health information, for example information about allergies or food sensitivities, if you provide this to us. We only collect sensitive information about you with your consent, or otherwise in accordance with the Privacy Act.

    Where you do not wish to provide us with your personal information, we may not be able to provide you with access to some or all of the Platform or other services.

    If we receive unsolicited personal information, we may retain it in accordance with this Privacy Policy if it is reasonably necessary for our activities or we are required to do so by law. Otherwise, we will take reasonable steps as soon as practicable to destroy or de-identify that information.
  4. Usage Data Collection

    eCoolroom also collects additional technical information, including usage data. eCoolroom collects usage data and other technical information for the maintenance and optimisation of the Platform.

    We log this usage data when you visit or otherwise use the Platform, such as when you view or click on pictures or videos or advertising, perform a search, or install or update one of our mobile apps. The data may include, among other information, the browser and operating system you are using, your IP address or other device identifier, location information provided by third party telecommunications providers, the URL or advertisement that referred you to the Platform, the search terms you entered into a search engine that led you to the Platform, areas within the Platform that you visited, and other information commonly shared when browsers communicate with websites. We may combine this automatically collected log information with other information we collect about you.

    may utilises cookies and/or embedded scripts on the Platform. We use cookies to identify specific machines in order to collect aggregate information on how visitors are experiencing the Platform. Embedded scripts allow us to collect information about your interactions with the Platform, such as the links you click on. This information will help to better adapt the Platform to suit personal requirements. While cookies allow a computer to be identified, they do not permit any reference to a specific individual. For information on cookie settings of your internet browser, please refer to your browser’s manual. Embedded scripts are temporarily downloaded onto your computer or other device and are deactivated or deleted when you disconnect from the Platform.

    • General

      As a general rule, we only collect and handle personal information for the purposes of providing and allowing your use of the Platform and any associated services, or any other purpose for which the personal information was originally collected or to which you consent.

      For example, we collect, hold, use and disclose personal information to, amongst other things:
      1. offer and provide you (or the business you represent) with the Platform;
      2. manage and administer the Platform, including account keeping procedures;
      3. analyse our data;
      4. enable Users and Vendors to use the Platform and transact with each other;
      5. recommend Vendors based on location, User preferences, discounts or special offers or other factors;
      6. confirm account details;
      7. communicate with you by phone or email or through messages within the Platform, including (but not limited to), replying to queries or notifying you of new discounts or special offers available;
      8. comply with our legal and regulatory obligations; and
      9. otherwise to manage and promote the Platform and our business.

      If you are a potential employee or a contractor of eCoolroom, we handle your information to carry out recruitment or engagement activities, communicate with you, manage our business relationship with you and perform or exercise our rights under contractual arrangements with you.

      Registration

      To register an account on the Platform you will need to provide certain personal information, including payment and billing information.

      Account

      Some or all of your account information (apart from your billing information) may be made available to any Vendors with which you transact.

      Messaging

      We collect information about you when you send, receive, or engage with messages in connection with the Platform. We may send you notifications or reminders in connection with the functionality of the Platform.

      Communications

      We or a Vendor may contact you by email, mobile phone, or through notices posted on the Platform, messages or push notifications to your account, and any other appropriate or necessary means. We may send you messages about the availability of the Platform, security, or other service-related issues. Vendors may send you messages relating to any transactions you have entered into with them, or any queries you have submitted to them. We also send messages about how to use the Platform, network updates, reminders, Vendor or product suggestions and promotional messages from time to time by us and our Vendors or other partners. You may change your communication preferences at any time. Please be aware that you cannot opt-out of receiving certain service messages from us or Vendors, including security and legal notices.

      Commenting and Reviews

      Any comments or reviews you submit via the Platform will be publicly available. You will be given the opportunity to select a pseudonym, in which case the name on your account will not be visible in connection with the comment or review. However, any pseudonyms will be recorded in your account information and may be visible to Vendors. Vendors.

      Business Development

      Any data collected may be used in eCoolroom's business to provide you with the Platform and associated services as well as to aid in eCoolroom's service improvement and marketing efforts, and may result in you being contacted by eCoolroom.

      We use data, including public feedback, to conduct research and development for the further development of the Platform in order to provide you and others with a better, more intuitive and personalised experience and drive growth and engagement on the Platform.

      We may use your data to generate statistics about our users, to calculate ad impressions served or clicked on, or to publish user or visitor demographics insights.

      Security

      We use your personal information (including your communications) if we think it is necessary for security purposes or to investigate possible fraud or other violations of this Privacy Policy and/or attempts to harm our Vendors, Users or Website visitors.
  6. Third Party Disclosure

    We may disclose personal information among members of the eCoolroom group or to third parties such as our Vendors or suppliers, organisations that provide us with technical and support services, or our professional advisors, subject to the Privacy Act.

    eCoolroom may share personal information with its affiliates and third parties to support the operation of eCoolroom's business and for marketing activities that may receive the data collected under this Privacy Policy. Third party recipients may include IT service providers, payment processing providers, support service providers and analytics and marketing service providers. However, other than where the recipient is a Vendor with which you transact, any such processing is limited to facilitating eCoolroom's own activities and eCoolroom does not share, sell or rent your personal information to any third parties for their promotional purposes. Where we disclose your personal information to a Vendor with which you have transacted, the Vendor may also use your personal information for its business and marketing purposes, subject to this Privacy Policy, its own privacy policy and applicable laws.

    We may also share data when required by law or to respond to legal process. In certain situations, eCoolroom may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements. If we disclose information to a third party, we generally require that the third party protect your information to the same extent that we do.
  7. Overseas transfers of personal information

    As at the date of this Privacy Policy, we are not likely to disclose personal information overseas recipients, unless you direct us to send your information to a particular overseas recipient. If in future we do propose to disclose personal information overseas, we will do so in compliance with the requirements of the Privacy Act. We will, where practicable, advise you of the countries in which any overseas recipients are likely to be located.

    From time to time we may engage an overseas entity to provide services to us, such as cloud-based storage solutions. Please note that the use of overseas service providers to store personal information will not always involve a disclosure of personal information to that overseas provider. By providing your personal information to us, you consent to disclosing your personal information to any such overseas recipients for purposes necessary or useful in the course of operating our business, and agree that APP 8.1 will not apply to such disclosures. For the avoidance of doubt, in the event that an overseas recipient breaches the Australian Privacy Principles, that entity will not be bound by, and you will not be able seek redress under, the Act.

  8. Protection, deletion and de-identification of personal information

    We will hold personal information as either secure physical records, electronically on our business systems, in cloud storage, and in some cases, records on third party servers. However, no method of transmission over the Internet, or method of electronic storage, is entirely secure. Thus, while we strive to protect your personal data, eCoolroom cannot ensure and does not warrant the security of any information you transmit using the Platform.

    We maintain appropriate physical, procedural and technical security for our offices and information storage facilities so as to prevent any loss, misuse, unauthorised access, disclosure, or modification of personal information. This also applies to disposal of personal information. In particular, transmission of your billing information is protected using secure socket layer technology (SSL).

    We further protect personal information by restricting access to personal information to only those of our employees and contractors who need access to the personal information do their job. Physical, electronic and managerial procedures have been employed to safeguard the security and integrity of your personal information.

    If you choose to close your eCoolroom account, your account information will generally be deleted within 30 days of account closure, except as noted below.

    We retain your personal information even after you have closed your account if reasonably necessary to comply with our legal obligations, meet regulatory requirements, resolve disputes, maintain security, prevent fraud and abuse, or fulfil your request to unsubscribe from further messages from us. We will retain de-identified information after your account has been closed.

    Information you have shared with others (e.g. through comments or reviews, or with Users or Vendors) will remain visible after you closed your account or deleted the information from your own account, and we do not control data that Vendors or other Users have copied out of the Platform. Comment or review content associated with closed accounts will show an unknown user as the source. Your profile may continue to be displayed in the services of others (e.g. search engine results) until they refresh their cache.
  9. Minors

    Minors under the age of 16 are not permitted to use the Services and Platform and we do not intentionally collect or maintain personal information from those who are under 16 years old. By using the Platform you are representing that you are at least 16 years old. eCoolroom reserves the right to request people under the age of 18 to obtain appropriate parental or guardian consent.

    If you believe that we may have collected personal information from someone under the age of 16 without proper consent, please let us know using the methods described in this Privacy Policy.
  10. Direct marketing

    Like most businesses, marketing is important to our continued success. We may use information from Users or Vendors for marketing purposes.

    We may provide you with information about new products, services and promotions either from us, Vendors or third parties which may be of interest to you.

    We provide your personal information to Vendors with which you transact, and those Vendors may use your personal information for marketing purposes. We will not disclose your personal information to other third parties for marketing purposes without your consent.

    You may opt out at any time if you no longer wish to receive commercial messages from us or Vendors. You can make this request by contacting our Privacy Officer or the Vendor respectively, or by using any other method available through the Platform or in any commercial message we or a Vendor sends to you. We or the Vendor will act on your request to opt out by ceasing to send you commercial messages within a reasonable time after receiving your request. Please be aware that you cannot opt-out of receiving certain service messages from us or Vendors, including security and legal notices.
  11. Accessing and correcting your personal information

    We provide choices about the collection, use and sharing of your personal information, from deleting or correcting data you include in your account and controlling the visibility of your comments/reviews to advertising opt-outs and communication controls. We offer you settings to control and manage the personal information we have about you.

    You may contact our Privacy Officer to request access to the personal information that we hold about you and/or to make corrections to that information, at any time. On the rare occasions when we refuse access, we will provide you with a written notice stating our reasons for refusing access. We may seek to recover from you reasonable costs incurred for providing you with access to any of the personal information about you held by us.

    We are not obliged to correct any of your personal information if we do not agree that it requires correction and may refuse to do so. If we refuse a correction request, we will provide you with a written notice stating our reasons for refusing.

    We will respond to all requests for access to or correction of personal information within a reasonable time.

You acknowledge that your continued use of the Platform after we publish or send a notice about our changes to this Privacy Policy means that the collection, use and sharing of your personal data is subject to the updated Privacy Policy.
